The upcoming Renters’ Rights Bill will abolish Section 21 – meaning you will need to use the Section 8 process to regain possession of your property. How does Section 8 work and what do you need to know? Our policy officer, Dan Cumming, explains.
While the vast majority of tenancies are ended by tenants themselves, at present landlords have the choice between using a Section 21 or a Section 8 notice. Section 21 notices don’t require you to give a specific reason for why you intend to regain possession, whereas Section 8 notices are based upon one of several grounds set out in the Housing Act 1988.
Section 21 is more commonly used currently. For that reason many landlords will not have experienced the Section 8 process.
